These Preview Terms are concluded in English, which is the language of the Preview. A German translation may be provided for convenience; in the event of any discrepancy between a translation and this English version, the English version shall prevail.
Scope of these Terms
These Terms of Service ("Preview Terms") govern the use of the IP Intelligence Tech Preview on the account level — that is, the creation, administration, and use of an individual account for the Preview. Where a commercial relationship exists between Alpha Strike Labs GmbH and the User's enterprise regarding the Alpha Strike Platform, that relationship is governed by the General Terms and Conditions for the Alpha Strike Platform v1.0 ("GTC"), individual master agreements, whitelabel agreements, or comparable contractual instruments. These Preview Terms do not replace such agreements but supplement them for the Preview on the account level.
The Platform Terms of Use for the Alpha Strike Platform v2.0 govern accounts for the Alpha Strike Platform. They do not govern the Preview, and these Preview Terms do not govern Alpha Strike Platform accounts. Where a User holds both, each set applies to its own account.
Preamble
Alpha Strike Labs GmbH ("Provider" or "Alpha Strike") operates IP Intelligence (the "Preview") at ip.alphastrike.io. IP Intelligence is a cloud-based service for searching Alpha Strike's existing internet-wide scan data and for reviewing the services observed on individual IP hosts.
The Preview is a technical preview: it is made available free of charge, for evaluation, and is under active development. Its functionality, limits, and availability may change at any time. Access requires the creation of an account and confirmation of the email address used.
These Preview Terms apply to any person who creates or uses an account for the Preview.
§ 1 Scope and Conclusion of Agreement
(1) These Preview Terms apply to the use of every account created for the Preview on ip.alphastrike.io or on a subdomain operated by Alpha Strike for the Preview. They become part of the agreement between Alpha Strike and the natural person using the account ("User") upon acceptance in the registration form and creation of the account. Where the User creates the account on behalf of an enterprise, these Preview Terms shall apply concurrently vis-à-vis the named enterprise.
(2) The Preview and any account are made available exclusively to entrepreneurs within the meaning of section 14 of the German Civil Code ("BGB"), legal persons under public law, and special funds under public law, and to their employees. Use for private purposes is excluded. Registration requires a business email address; temporary and disposable email domains are not accepted.
(3) Where a master agreement framework within the meaning of the "Scope of these Terms" section above exists between Alpha Strike and the User's enterprise, that framework shall prevail over these Preview Terms in case of any conflict concerning the service relationship. These Preview Terms shall apply on a supplementary basis for the account level and for any matters not regulated by such framework. Where no such framework exists, these Preview Terms shall apply and the GTC v1.0 shall apply on a supplementary basis.
(4) General terms and conditions or purchasing terms of the User or the User's enterprise shall not become part of these Preview Terms, even if Alpha Strike does not expressly object thereto.
§ 2 Subject Matter of the Preview
(1) The Preview searches scan data already held by Alpha Strike and returns unique IP hosts together with the observed services that caused the match, plus bounded host context. It describes externally observable exposure as recorded by an earlier scan observation.
(2) The Preview is read-only with respect to that data. It performs no scan on request, and a search does not cause Alpha Strike to contact the IP addresses returned. § 7 describes the one function that originates traffic to a third-party system, and only where that function is made available.
(3) Results are observations, not conclusions. In particular, they do not establish ownership of an asset, do not constitute an assessment of threat, and do not establish the presence or absence of a vulnerability. Absent enrichment means unknown, not unaffected. Counts may be approximate and are labelled as such in the interface; partial results are labelled as partial. The age of an observation varies and is stated per observation where available.
(4) The User is responsible for validating results before acting on them and for the consequences of any action taken on the basis of results. Alpha Strike does not warrant the accuracy, completeness, or timeliness of any content provided through the Preview.
(5) The Preview provides no export, no download of results, no search history, no saved searches, and no first-seen or historical data.
§ 3 Preview Character, Duration, and Changes
(1) The Preview is provided free of charge and serves the sole purpose of internal evaluation by the User's enterprise for its own security, risk, and compliance purposes.
(2) Alpha Strike may at any time, in its sole discretion, change, restrict, suspend, or discontinue the Preview or any individual function, in whole or in part, with or without notice. The User shall have no entitlement to a minimum duration, to a particular functionality, to a particular level of availability, to conversion into a paid agreement, or to the migration of data into a successor environment.
(3) Accounts for the Preview are trial accounts. Alpha Strike determines the duration of the trial and may shorten or extend it at any time. Neither automatic extension nor automatic conversion to a paid agreement shall occur. Upon the end of the trial duration or of the Preview, Alpha Strike may deactivate the account and delete the associated data in accordance with § 12 (3). The Preview offers no read-only wind-down mode and no export, so the User should not treat it as a store of record.
(4) Conversion to a paid agreement is effected exclusively manually — by execution of an order form, acceptance of an individual offer, or incorporation into an existing master agreement of the User's enterprise.
§ 4 Account, Credentials, and Administration
(1) An account is personal and non-transferable. The disclosure of credentials to third parties is prohibited. Use of a single account by several individuals is not permitted; additional users require their own accounts.
(2) The User is obliged to keep the credentials confidential, to use a sufficiently strong password, and to enable the security features offered by the Preview where required by Alpha Strike. The User shall notify Alpha Strike without undue delay of any suspected compromise of the credentials.
(3) Actions performed via the User's account shall be deemed actions of the User or, as applicable, of the enterprise behind the account, unless the User proves that Alpha Strike is responsible for the misuse.
(4) During the Preview, accounts are administered within one shared Alpha Strike preview tenancy. The Preview provides no separate tenant administration, no team or role management, and no self-service deletion or export of account data. Requests concerning an account are handled by email in accordance with § 12 (2).
(5) Alpha Strike may, in its sole discretion and without prior notice, adjust at any time the functional scope, performance limits, rate limits, and other technical parameters of an account, in particular to secure the Preview, to prevent misuse, or to manage load.
§ 5 Usage Limits
(1) Use of the Preview is subject to limits. During the Preview each account may run twenty (20) searches per calendar day, counted per person; the allowance resets daily. The limits in force are described in the IP Intelligence user guide.
(2) Limits are ceilings, not entitlements.Alpha Strike may lower or raise any limit at any time, including in response to aggregate use of the Preview by all users. A refusal caused by a limit — including a limit that applies to the platform as a whole rather than to the User's account — is not a defect and does not constitute a breach by Alpha Strike. The same applies to a refusal caused by capacity.
(3) The User shall not circumvent any limit, in particular not by creating or using more than one account, by sharing an account, or by automating the interface.
(4) The Preview is made available through the interface provided by Alpha Strike. Programmatic access, automated or bulk retrieval of results, and systematic extraction of data from the Preview are not part of the Preview and are prohibited.
§ 6 Code of Conduct — Permitted and Prohibited Use
(1) Purpose and self-conception of the Preview. IP Intelligence is a defensive cybersecurity tool. It supports enterprises in identifying their own digital attack surface, in assessing their suppliers and acquisition targets for cyber risk, and in responding to security incidents. The User commits to this self-conception and uses the Preview exclusively in this sense and in accordance with the rights of third parties.
(2) Red lines. Without prejudice to the prohibitions set out in § 3 (3) GTC, the use of the Preview and of its content is excluded at all times for the following purposes:
- identification, monitoring, assessment, or profiling of natural persons outside a concrete cybersecurity context;
- employee monitoring, background screening in the labor- or criminal-law sense, credit assessment, and political, ideological, or religious profiling;
- preparation or execution of cyber attacks, or authentication against systems in respect of which the User has no legitimate interest in investigation;
- causing load on a third-party system, whether alone or in aggregate with other accounts;
- using the Preview to obscure the origin of a request — that is, as a means of retrieving content that the User wants but does not want attributed to the User;
- retrieving content that the User is not permitted to retrieve, and retrieving unlawful content;
- circumventing the limits under § 5, in particular by creating multiple accounts;
- development, expansion, or improvement of a competing service or competing data set;
- law enforcement without official authorization, and any other activities which under applicable law require regulatory approval, in the absence of such approval.
(3) Security obligations of the User.The User shall implement at least the following minimum measures: (i) use of the Preview exclusively from devices managed by the enterprise or from devices with up-to-date security configuration; (ii) activation of the security features offered by the Preview where offered; (iii) non-disclosure of credentials; (iv) handling of results in accordance with the User's own security policies.
(4) Preview-specific restrictions. In addition: (i) no publication of feature descriptions, screenshots, or comparison or benchmark results; (ii) no disclosure of results to third parties beyond the circle of persons necessary for the evaluation; (iii) no commercial use of results; (iv) no parallel or successive accounts of the same enterprise in order to circumvent a limit or the trial duration.
(5) Cooperation in cases of suspicion. The User shall report indications of a violation of this § 6 — whether by itself, by other employees of its enterprise, or by third parties — without undue delay to abuse@alphastrike.io and shall cooperate within reasonable bounds in the investigation.
(6) Consequences of violations. In the event of a violation of this § 6, of § 5, of § 7, or of § 3 (3) GTC, Alpha Strike shall be entitled, without prior warning and with immediate effect, to suspend or restrict access, to disable individual functions for one account or for all accounts, to block the account permanently, to terminate the Preview relationship for good cause, to assert claims for damages, and to notify competent authorities where required by law. Alpha Strike shall determine the severity of the measure at its reasonable discretion.
§ 7 Website Captures
Where and for as long as Alpha Strike makes a website capture function available to the User's account, the following applies in addition to §§ 5 and 6.
(1) What a capture does. When the User requests a capture for an individual HTTP or HTTPS service, Alpha Strike originates an HTTP request to that third-party system and renders the response, including executing the scripts that the system serves. The request is made from Alpha Strike infrastructure and not from the User's own address, and is therefore attributed to Alpha Strike by the operator of the target system.
(2) Undertaking by the User. For each individual targetfor which the User requests a capture, the User undertakes that it is entitled to request the retrieval of that target's content. This undertaking is given per target and not in respect of use of the Preview in general. Alpha Strike does not verify that entitlement and is not in a position to do so; the assessment is the User's alone.
(3) No free-form target.A capture can be requested only for a service already contained in Alpha Strike's scan data. URLs, host names, and other freely chosen targets cannot be submitted.
(4) Limits. Captures are subject to limits which are ceilings within the meaning of § 5 (2). At the time of this version these are twenty (20) captures per user per day, one hundred (100) captures per day for the Preview as a whole, and at most one capture per target per twenty-four (24) hours. Alpha Strike may lower or raise these limits at any time. A refusal caused by the platform-wide limit is not a defect.
(5) Retention, and what the User does not receive. A capture is stored for a maximum of seven (7) days and is then deleted automatically. Only the most recent capture per service exists; there is no history. A capture cannot be downloaded or exported and is not made searchable. A capture request may be answered from stored data instead of being taken afresh; the image displayed may therefore be up to seven days old and must not be relied upon as a record of the target's current state.
(6) Third-party content and takedown. Alpha Strike does not review the content of a capture before it is displayed and makes no representation that it is lawful, accurate, or complete. Requests concerning a capture — in particular by the operator of a target system — may be sent to abuse@alphastrike.io and are processed within five (5) working days. Where Alpha Strike deletes a capture on such a request, it also excludes that target from future captures, so that the deletion is not undone by a subsequent request; the automatic deletion under paragraph (5) applies in any event as the outer limit.
(7) Personal data in captures. A capture may contain personal data. Alpha Strike stores it on the basis of its legitimate interests pursuant to Art. 6 (1) (f) GDPR, restricts access to authenticated users of the Preview, and deletes it in accordance with paragraph (5). The privacy information referred to in § 8 is authoritative for the details.
§ 8 Data Protection
(1) The processing of personal data in connection with the Preview is described in the privacy information for the Preview, which is provided at registration and is available on request from datenschutz@alphastrike.io. That privacy information, not these Preview Terms, is authoritative for data protection roles, purposes, legal bases, recipients, transfers, and retention. Alpha Strike and the User's enterprise shall, unless expressly provided otherwise therein, each act as separate controllers within the meaning of the GDPR.
(2) Alpha Strike records the fact, time, outcome, and volume of the searches performed under an account for the purposes of security, abuse prevention, and usage accounting. The content of a search — in particular the search expression and the addresses, domains, and organizations contained in it — is not stored for those purposes.
(3) The Preview uses exclusively technically necessary cookies that are required for sign-in, session management, and the operation of the web application. No tracking, analytics, marketing, or third-party cookies are used.
(4) Marketing communications by email.By accepting these Preview Terms the User consents, pursuant to Art. 6 (1) (a) GDPR, to Alpha Strike using the contact details provided at registration — in particular the email address — in order to send the User electronic marketing communications concerning Alpha Strike's own products, services, events, publications, and research, including the Alpha Strike Platform and the further development of IP Intelligence. Paragraph (3) concerns cookies only and does not limit this consent. Messages necessary for the operation of the account — in particular confirmation of the email address, security notices, and notices under § 14 (2) — are sent irrespective of this consent and are not marketing communications.
(5) Withdrawal. The consent under paragraph (4) may be withdrawn at any time with effect for the future, without giving reasons and at no cost other than the transmission costs at basic rates, by email to datenschutz@alphastrike.ioor via the unsubscribe link contained in every marketing message. Withdrawal does not affect the lawfulness of the processing carried out on the basis of the consent before its withdrawal, and does not affect the User's access to the Preview.
§ 9 Confidentiality and Feedback
(1) The Preview, its functionality, its performance, and the results obtained from it are confidential information of Alpha Strike. § 6 (4) applies.
(2) The User may provide feedback on the Preview. Alpha Strike may use such feedback without restriction, free of charge, and without obligation to the User, in particular for the further development of its products. Alpha Strike is under no obligation to implement feedback and gives no commitment as to its roadmap.
§ 10 Rights in the Preview and in Results
(1) All rights in the Preview, in the underlying scan data, and in the results provided through it remain with Alpha Strike. The User receives, for the duration of the Preview, a non-exclusive, non-transferable, revocable right to use results internally within its enterprise for the evaluation purpose set out in § 3 (1).
(2) Any resale, redistribution, publication, or making available of results to third parties, any use of results to build or improve a competing data set or service, and any automated extraction of results are prohibited.
§ 11 Availability and Support
(1) No specific availability, response time, or restoration time is owed for the Preview. No service level agreement applies to it. Alpha Strike may perform maintenance and interrupt the Preview without prior notice.
(2) Support is provided on a best-effort basis by email to support@alphastrike.io.
§ 12 Suspension, Termination, and Deletion
(1) Alpha Strike may at any time temporarily suspend, restrict, or permanently terminate the User's account, in particular in the event of violations of these Preview Terms, of the applicable master agreement framework, or of applicable law, in case of suspected misuse, in case of false or incomplete information provided at registration, where the legitimate interest no longer exists, and for operational, security-related, or legal reasons. Alpha Strike shall determine the severity of the measure at its reasonable discretion; no prior consultation or warning is required.
(2) The User may terminate the account at any time by email to support@alphastrike.io. The Preview provides no self-service deletion function. Termination of the account does not affect any master agreement framework between Alpha Strike and the User's enterprise.
(3) Upon termination of the account, upon the end of the trial duration, or upon the end of the Preview, Alpha Strike may delete or block the personal data associated with the User and any content processed in the account, unless statutory retention obligations or contractual obligations under an applicable master agreement framework require otherwise. There is no obligation to retain, export, or hand over data beyond the requirements set out in this provision.
§ 13 Liability and Indemnification
(1) Since the Preview is provided free of charge, Alpha Strike's liability shall be limited, in line with § 9 (8) GTC, to intent and gross negligence; any liability that exists as a matter of mandatory law shall in any event be capped at EUR 1,000.
(2) Liability for damage arising from injury to life, body, or health, liability under the German Product Liability Act, and any other liability which cannot be excluded or limited as a matter of mandatory law remain unaffected by paragraph (1).
(3) These Preview Terms do not establish independent liability of Alpha Strike for the accuracy, completeness, or timeliness of any content provided through the Preview, nor for decisions taken by the User on the basis of such content.
(4) Indemnification.The User shall indemnify Alpha Strike and its legal representatives, employees, officers, agents, and subcontractors against any third-party claims arising from a breach of these Preview Terms — in particular of § 6 and § 7 —, from the unlawful selection of targets, from the unlawful use of results, or from misuse of the User's account, including reasonable defense costs. § 4 (3) GTC shall apply accordingly.
§ 14 Acceptance, Versioning, and Amendments
(1) These Preview Terms are accepted in the registration form. Alpha Strike records the acceptance against the version identifier of the version displayed, together with the date and time, and stores it on the account.
(2) Alpha Strike may amend these Preview Terms at any time, in particular to implement legal, security, technical, or product-related requirements and to reflect changes in the functionality of the Preview. The version identifier changes whenever the substance changes. Amended Preview Terms shall be communicated to the User in text form or via the Preview with a notice period of seven (7) calendar days. For amendments required to address concrete security or legal risks, the notice period may be waived.
(3) If the User does not object to the amended Preview Terms within the notice period, they shall be deemed accepted. In the event of a timely objection, Alpha Strike may terminate the account effective on the effective date of the amendment.
(4) An acceptance recorded against an earlier version does not extend to a later version. Alpha Strike may request renewed acceptance and may make continued use of the Preview conditional upon it.
§ 15 Final Provisions
(1) The relationship between Alpha Strike and the User shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for any disputes arising out of or in connection with these Preview Terms shall be Berlin.
(2) Should any provision of these Preview Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the economic purpose of the invalid provision.
(3) Amendments and additions to these Preview Terms shall be made in text form; § 14 shall remain unaffected.
